Requesting Wheelchair Assistance

Persons with disabilities should first contact their airline in advance to arrange special services such as boarding assistance, wheelchair needs, seat assignments, medication storage, and food
requirements.

Lafayette Regional Airport, in compliance with federal and state laws and regulations, including the Americans with Disabilities Act of 1990 (ADA) and Section 504 of the Rehabilitation Act of 1973, does not discriminate on the basis of disability in the administration of its programs and activities. Title VI Complaint Procedure, Instructions and Forms
The Lafayette Regional Airport has established, pursuant to Title VI of the Civil Rights Act of 1964, the following Complaint Procedure to be used by persons who allege a violation of Title VI. These procedures are for complaints of discrimination.

If you believe that you have been excluded from participation in, denied the benefits of, or subjected to discrimination based on race, color, national origin, sex, religion, creed, or disability in the receipt of the Airport’s services or related benefits, you may submit a written complaint to Lafayette Regional Airport DBELO, Title VI Coordinator.

Time is crucial when filing a complaint with the Lafayette Regional Airport Title VI Coordinator. Complaint letters must be submitted within ninety (90) calendar days from the date of the discriminatory action.

Federal regulations do not require individuals to use this Complaint Procedure, but individuals may file complaints directly with the appropriate outside agency, such as the U.S. Department of Transportation or the Federal Aviation Administration (FAA).

 

ADA/504 Procedures

Purpose

Lafayette Regional Airport is committed to compliance with the Americans with Disabilities Act (ADA), as amended, and Section 504 of the Rehabilitation Act of 1973. These laws prohibit discrimination on the basis of disability and require the provision of reasonable accommodations to qualified individuals with disabilities.

Request for Accommodation – Process Overview

  1. Submission of Request The employee or applicant submits a Request for Accommodation Form to the Department of Human Resources, ADA/504 Coordinator, Director – Human Resources & Administration.
  2. Documentation Submission The employee or their healthcare provider submits relevant supporting documentation as outlined in this information packet.
  3. Interactive Process Meeting Upon receipt of sufficient documentation, Human Resources and/or ADA/504 Coordinator will meet with the employee or applicant to engage in an interactive process to determine eligibility and identify effective reasonable accommodations.
  4. Accommodation Determination If eligibility is established, Human Resources/ADA Coordinator will develop a written Accommodation Plan on a case-by-case basis.
  5. Distribution of Plan Copies of the approved Accommodation Plan will be provided to the employee and the appropriate Manager. A copy will be maintained in a confidential ADA/504 file.

Timeline

Within ten (10) business days of receiving notice that an accommodation may be needed, Human Resources and/or ADA/504 Coordinator will initiate the interactive process. Determinations will be made as promptly as possible, barring extenuating circumstances.

Confidentiality

All medical and disability-related information is maintained in confidential files separate from personnel records and is disclosed only to individuals with a legitimate business need to know, in accordance with ADA requirements.

Financial Impact Review

Any accommodation with a potential financial or operational impact will be referred to the Executive Director for review. A determination will generally be made within ten (10) business days of referral.

Appeals Process

If an employee or applicant is found ineligible for accommodation under ADA/504, an appeal may be submitted in writing to the Executive Director. The Executive Director will convene a review committee consisting of:

  • Deputy Director
  • Director – Human Resources & Administration
  • Appropriate Compliance Coordinator

A written decision will be issued within thirty (30) days of receipt of the appeal.

Grievance Process

If an approved accommodation plan is not implemented or followed, the employee may file a grievance with the ADA/504 Coordinator in accordance with the Lafayette Airport Commission’s Disability Discrimination Grievance Procedure.

Documentation Guidelines

Documentation should:

  • Be completed by a qualified healthcare or diagnostic professional
  • Describe the functional limitations related to the individual’s condition
  • Explain how the condition impacts major life activities or essential job functions
  • Include recommended accommodations, if applicable

Recency of documentation will be evaluated on a case-by-case basis, depending on the nature, stability, and duration of the condition.

Definition of Disability (ADA/504)

An individual with a disability is a person who:

  • Has a physical or mental impairment that substantially limits one or more major life activities;
  • Has a record of such an impairment; or
  • Is regarded as having such an impairment.

Major life activities include, but are not limited to, walking, seeing, hearing, speaking, learning, working, performing manual tasks, and concentrating.

It is the policy of Lafayette Airport Commission not to discriminate on the basis of disability. Lafayette Airport Commission has adopted this internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by the Americans with Disabilities Act or Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and the U.S. Department of Transportation and U.S. Department of Health and Human Services regulations implementing the Acts. The Americans with Disabilities Act provides civil rights protections to individuals with disabilities and guarantees equal opportunity in public accommodations, employment, transportation, state and local government services, and telecommunications. Section 504 prohibits discrimination on the basis of disability in any program or activity receiving Federal financial assistance.

Any person who believes she or he has been subjected to discrimination on the basis of disability may file a complaint under this grievance procedure. It is against the law for Lafayette Airport Commission to retaliate against anyone who files a complaint or cooperates in the investigation of a complaint.

Procedure:

(a) A complaint must be filed with the ADA/504 Coordinator within seven (7) days of the date the person filing the complaint (complainant) becomes aware of the alleged discriminatory action. A complaint is filed when it is received by the Section 504 Coordinator at the address provided above.
(b) A complaint must be in writing, containing the name and address of the person filing it. The complaint must state the problem or action alleged to be discriminatory and the remedy or relief sought.
(c) The ADA/504 Coordinator (or her/his designee) shall conduct an investigation of the complaint. This investigation may be informal, but it must be thorough, affording all interested persons an opportunity to submit evidence relevant to the complaint. The ADA/504 Coordinator will maintain the files and records of Lafayette Airport Commission relating to such complaints.
(d) The ADA/504 Coordinator will issue a written decision on the complaint no later than 30 days after its filing.
(e) The complainant may appeal the decision of the ADA/504 Coordinator by submitting a request for appeal in writing to the Executive Director of the Lafayette Airport Commission, at the address/email address below, within 15 days of receiving the ADA/Section 504 Coordinator’s decision. The Executive Director shall consider the request for appeal and issue a written decision to the complainant no later than 30 days after its filing.

(f) The availability and use of this grievance procedure shall not prevent a person from filing a complaint of discrimination on the basis of disability with the U.S. Department of Transportation, Federal Aviation Administration, Office for Civil Rights or the U. S. Department of Health and Human Services, Office for Civil Rights.

Lafayette Airport Commission will make appropriate arrangements to ensure that disabled persons are provided other accommodations, if needed, to participate in this grievance process. Such arrangements may include, but are not limited to, providing interpreters for the deaf, providing audio recordings of material for the blind, or assuring a barrier-free location for the proceedings. The ADA/504 Coordinator will be responsible for such arrangements.
